Acceptable Use Policy

Last updated October 7, 2026. Published by Lumen-Labs, Geneva.

1. Purpose

This Acceptable Use Policy (the "AUP") sets out the rules governing the use of the Carpe Diem Protocol (the "Protocol") and its AI inference services. This AUP supplements the Terms of Use and is incorporated by reference therein.

By using the Protocol, you agree to comply with this AUP. Violation of this AUP may result in immediate suspension or termination of access without notice.

2. Prohibited Uses — EU AI Act (Article 5)

In accordance with Regulation (EU) 2024/1689 (the "EU AI Act"), the following uses of the Protocol's AI inference services are strictly prohibited:

2.1 Social Scoring

Using the Protocol to evaluate, classify, or score natural persons based on their social behavior, personal characteristics, or predicted personality traits, where such scoring leads to detrimental or unfavorable treatment of those persons in contexts unrelated to the original data collection.

2.2 Subliminal Manipulation

Using the Protocol to deploy techniques that operate below the threshold of a person's consciousness, or purposefully manipulative or deceptive techniques, with the objective or effect of materially distorting the behavior of a person or group in a manner that causes or is reasonably likely to cause significant harm.

2.3 Exploitation of Vulnerabilities

Using the Protocol to exploit vulnerabilities of specific persons or groups due to their age, disability, social or economic situation, with the objective or effect of materially distorting their behavior in a manner that causes or is reasonably likely to cause significant harm.

2.4 Real-Time Remote Biometric Identification

Using the Protocol to perform real-time remote biometric identification of natural persons in publicly accessible spaces for law enforcement purposes, except where and insofar as strictly permitted under the EU AI Act.

2.5 Biometric Categorization

Using the Protocol to categorize natural persons based on biometric data to infer sensitive attributes including race, political opinions, trade union membership, religious or philosophical beliefs, sex life, or sexual orientation, except for lawful purposes in the area of law enforcement.

2.6 Predictive Policing (Individual)

Using the Protocol to make risk assessments of natural persons in order to assess or predict the risk of a natural person committing a criminal offense, based solely on profiling or personality traits.

2.7 Facial Recognition Database Creation

Using the Protocol to create or expand facial recognition databases through untargeted scraping of facial images from the internet or CCTV footage.

2.8 Emotion Recognition in Workplace and Education

Using the Protocol to infer the emotions of natural persons in workplace or educational settings, except where the use is intended for medical or safety reasons.

3. Prohibited Uses — General

In addition to the AI-specific prohibitions above, the following uses of the Protocol are prohibited:

3.1 Illegal Activity

Using the Protocol to facilitate, promote, or engage in any activity that violates applicable laws or regulations in any jurisdiction, including but not limited to fraud, money laundering, terrorist financing, trafficking, or the distribution of illegal content.

3.2 Harm to Minors

Using the Protocol to generate, solicit, or distribute content that exploits, harms, or endangers minors in any way, including the generation of child sexual abuse material (CSAM).

3.3 Non-Consensual Intimate Content

Using the Protocol to generate intimate, sexual, or nude imagery of real persons without their explicit consent (including deepfakes).

3.4 Harassment and Threats

Using the Protocol to harass, threaten, stalk, intimidate, or incite violence against any person or group.

3.5 Malware and Cyber Attacks

Using the Protocol to develop, distribute, or deploy malware, ransomware, exploit code, or to conduct or facilitate cyber attacks against any system or network.

3.6 Disinformation Campaigns

Using the Protocol to generate or disseminate false information at scale with the intent to deceive the public, manipulate elections, or undermine public institutions.

3.7 Impersonation

Using the Protocol to impersonate real persons, organizations, or government entities without authorization, in a manner likely to mislead or cause harm.

3.8 Circumvention of Safety Measures

Using the Protocol specifically to bypass, circumvent, or test the safety measures, content filters, or usage restrictions of the upstream AI models, except in the context of authorized security research.

Uploading a voice sample for voice cloning unless it is your own voice or its speaker has expressly agreed to it being cloned, and using a cloned voice to impersonate a real person, deceive listeners, or bypass voice-based authentication. You must be able to show the speaker's agreement on request.

3.10 Payment Fraud

Using a payment card or account without authorization, filing unjustified chargebacks, or splitting purchases across accounts to circumvent purchase limits.

4. Your Responsibilities

4.1. You are solely responsible for all content you submit to and generate through the Protocol.

4.2. You must not use the Protocol in any manner that could damage, disable, overburden, or impair the Protocol or interfere with any other party's use.

4.3. You must comply with all applicable laws and regulations in your jurisdiction when using the Protocol, including but not limited to export control laws, data protection laws, and intellectual property laws.

4.4. If you use the Protocol's output in any public-facing application, you must clearly disclose that the content was generated by AI. This includes synthetic speech and cloned voices.

5. Enforcement

5.1. We reserve the right to investigate suspected violations of this AUP and to take appropriate action, including but not limited to suspension or termination of access, reporting to law enforcement authorities, and cooperation with legal proceedings.

5.2. We do not proactively monitor the content of AI inference requests or responses, and the Operator does not store them, beyond a short-lived cache of generated media (see the Privacy Policy). However, we may investigate reports of AUP violations and may implement automated detection measures where technically feasible and legally required. Requests served by Venice.ai or by third-party inference markets are also subject to those providers' own content policies.

5.3. To report a violation of this AUP, contact: info@lumen-labs.ch

6. Changes

We may update this AUP from time to time to reflect changes in applicable law, regulatory guidance, or Protocol capabilities. Material changes will be communicated through the Protocol's frontend or documentation. Continued use of the Protocol after any update constitutes acceptance of the revised AUP.
